Terms of Service
These Terms of Service (the "Terms") govern your use of the website at betterhealthmap.com and the services provided by BetterHealthMap (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
1. Acceptance of Terms
By creating an account, accessing, or otherwise using the Services, you confirm that you accept these Terms and agree to comply with them. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must be at least 13 years old to use the Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of the Services
BetterHealthMap provides educational health and wellness information, planning tools, and AI-assisted insights designed to help you organize and reflect on your health habits and goals. The Services include a Health Map, Wellness Score, roadmap, goal and habit tracking, metrics tracking, document storage, and an AI navigator.
The Services are educational and informational in nature. They are not a medical service, do not provide medical diagnosis or treatment, and are not a substitute for professional medical advice, diagnosis, or care. The Wellness Score and any insights provided are educational wellness indicators, not medical diagnoses or validated predictors of disease or lifespan. 3. Your Account and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. You are responsible for the accuracy of the information you provide to the Services, including health and wellness information used to generate your Health Map and insights.
You agree to provide accurate and truthful information when using the Services. The quality and relevance of the insights and recommendations you receive depend on the accuracy of the information you provide.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right.
- Upload, store, or share content that is unlawful, harmful, defamatory, infringing, or otherwise objectionable.
- Attempt to gain unauthorized access to the Services, other accounts, or our systems.
- Interfere with or disrupt the Services, including introducing viruses, malware, or other harmful code, or attempting to overload, crash, or reverse-engineer the Services.
- Use the Services to provide medical advice to others or to operate as a medical or diagnostic service.
- Scrape, crawl, or otherwise systematically extract data from the Services, except as explicitly permitted.
- Resell, sublicense, or redistribute access to the Services without our written permission.
5. Subscriptions and Billing
Some features of the Services require a paid subscription. Subscription plans, features, and pricing are displayed on our pricing page and may change from time to time. All fees are billed in United States dollars (USD).
When you subscribe, you authorize us to charge the applicable fees to your selected payment method on a recurring basis until you cancel. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access until then unless otherwise stated. Fees are non-refundable except where required by applicable law.
We may change our fees and subscription terms upon reasonable notice. Any price changes will apply to your next billing cycle following the notice.
6. Intellectual Property
The Services, including their design, features, text, graphics, logos, and software, are owned by BetterHealthMap and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our written permission.
You retain ownership of the information and content you provide to the Services, including your health and wellness information, uploaded documents, and goals. By providing content to the Services, you grant us a limited license to process that content as necessary to operate and improve the Services for you.
7. Disclaimers
The Services are provided on an "as is" and "as available" basis. Except as required by law, BetterHealthMap disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any results or insights will be accurate or reliable.

8. Limitation of Liability
To the maximum extent permitted by law, BetterHealthMap and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Because the Services are educational and not a medical service, BetterHealthMap is not liable for any health decisions you make based on the Services. You are solely responsible for decisions regarding your health and for seeking appropriate professional medical care.
9. Indemnification
You agree to indemnify and hold harmless BetterHealthMap and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
10. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if you violate these Terms or if we believe you are using the Services in a way that could harm us or others. Upon termination, your right to use the Services ends immediately.
The following sections survive termination: intellectual property, disclaimers, limitation of liability, indemnification, and any other provisions that by their nature should survive.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will notify you through the Services or by email before the changes take effect. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms or the Services will be resolved in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts.
